Disputes regarding payments, refunds, or account issues on those platforms must be directed to the respective provider.


3. Pricing & Availability

  • All prices are subject to change without notice.

  • Menu items and promotions are subject to availability.

  • Prices displayed on third-party platforms may differ from in-store pricing.

  • We reserve the right to correct pricing errors at any time.

We are not responsible for typographical errors or outdated information.


4. Food Allergy & Consumption Disclaimer

While we strive to accommodate dietary needs:

  • Our kitchen handles ingredients including but not limited to dairy, gluten, soy, eggs, and other common allergens.

  • We cannot guarantee that any menu item is completely free of allergens.

  • Customers with severe allergies consume our food at their own risk and should notify staff of allergies prior to ordering.


5. Refunds & Order Issues

Refund policies may vary depending on how the order was placed:

  • In-store orders must be addressed directly with management at the time of service.

  • Orders placed through DoorDash or Uber Eats must be resolved through those platforms.

  • Orders processed via Square may be subject to review before refunds are issued.

We reserve the right to deny refund requests that are fraudulent, abusive, or inconsistent with our policies.

  • Third-party delivery issues: delays, mishandling, incorrect routing, temperature changes, or service interruptions caused by DoorDash, Uber Eats, or any other delivery service.

  • Payment and platform errors: technical malfunctions, failed transactions, or order discrepancies associated with Square or other third-party platforms.

  • Information inaccuracies: pricing errors, outdated promotions, or incorrect menu items displayed on our website or third-party platforms.

  • Allergic reactions or food-related issues: consumption of menu items containing allergens or ingredients that may cause adverse reactions.

Once an order leaves our premises for delivery via a third-party service, responsibility for handling, timing, and condition rests with that service provider.

We shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use of our website, products, or services. Our total liability for a specific transaction shall not exceed the amount paid for that transaction.


10. Chargeback & Payment Protection

To protect our customers and business:

  1. Verification of Transactions:
    All payments processed through Square, DoorDash, or Uber Eats are verified and recorded. Disputes must be raised directly with the platform or payment provider.

  2. Chargebacks:

    • Customers initiating chargebacks must provide valid reasons consistent with platform policies.

    • Fraudulent or unwarranted chargebacks may be contested, and the customer may be held responsible for fees or legal costs.

    • We reserve the right to refuse future service to customers who attempt fraudulent chargebacks.

  3. Refunds:
    Refunds are only issued according to platform policies or documented in-store procedures. Refunds are not guaranteed for orders processed by third-party delivery services.

  4. Record Keeping:
    We maintain detailed records of all transactions, receipts, and communication for dispute resolution and chargeback claims.


11. Catering Services Disclaimer

Mr. Kofta offers catering services for events, parties, and gatherings. All catering orders are prepared for pickup only. By placing a catering order, you agree to the following:

  1. Pickup Only:
    We are not responsible for transporting, storing, or serving food once it leaves our premises.

  2. Food Safety:
    Catered food should be consumed promptly after pickup. We are not responsible for foodborne illness resulting from improper handling, storage, or delayed consumption.

  3. Menu & Substitutions:
    Ingredients may be substituted due to availability or quality. Menu items may change slightly without notice.

  4. Payment & Deposits:
    Deposits may be required for catering orders and are non-refundable unless otherwise agreed. Final payment is due prior to pickup.

  5. Order Accuracy:
    Customers are responsible for reviewing their order at pickup to ensure all items and quantities are correct. We are not liable for errors reported after the order has been taken from our premises.

  6. Allergens:
    Our kitchen handles common allergens. Clients must inform us of known allergies. We are not liable for allergic reactions unless negligence on our part is proven.


12. Governing Law

These Terms are governed by the laws of the State of North Carolina and applicable U.S. federal law. Any disputes shall be resolved exclusively in the courts located within North Carolina.


13. Changes to Terms

We reserve the right to modify these Terms at any time without prior notice. Changes become effective immediately upon posting. Continued use of the Website constitutes acceptance of the updated Terms.
